Acceptable Use Policy

This Acceptable Use Policy ("AUP") sets out what you can and cannot do with Tradeloper. It exists to protect your business, your customers, and the integrity of review platforms like Google and Facebook. Violating this policy may result in your account being suspended or terminated.
1. SMS Rules — What You Must Do
- Only add customers who have consented to receive SMS from your business. Consent must be obtained before you add their number to Tradeloper.
- Honour opt-outs immediately. If a customer replies STOP, do not contact them again via SMS.
- Register your 10DLC campaign. As of February 2025, US carriers block unregistered SMS traffic. You must register your business phone number and SMS campaign with your carrier. Without this, messages will not be delivered.
- Only send to real customers. Do not add phone numbers of people who have not done business with you.
2. Review Request Rules — What You Must Do
- Ask all customers equally. Do not selectively send review requests only to customers you think are happy. This is called "review gating" and is prohibited by Google's policies and the FTC Consumer Review Rule (16 CFR Part 465, effective October 2024).
- Never offer incentives for reviews. Do not offer discounts, gifts, cash, or any reward in exchange for leaving a review. This violates FTC rules (up to $53,088 per violation) and Google's policies (results in all reviews being removed).
- Do not direct customers to Yelp. Yelp explicitly prohibits businesses from asking customers to leave reviews. Doing so will result in a public "Suspicious Activity" warning on your Yelp listing.
- Do not solicit fake reviews. Never ask friends, family, or employees to leave reviews pretending to be customers. This is fraud and a violation of FTC rules.
3. Prohibited Uses
You may not use Tradeloper to:
- Send spam or bulk unsolicited messages
- Harass, threaten, or intimidate customers
- Suppress, hide, or discourage negative reviews
- Create or distribute fake, misleading, or fabricated reviews
- Impersonate another business or person
- Violate any applicable law, including TCPA, CAN-SPAM, GDPR, or the FTC Consumer Review Rule
- Attempt to reverse-engineer, scrape, or copy the Tradeloper platform
- Resell or white-label Tradeloper without written permission
4. Platform Policy Compliance
You are responsible for complying with the terms and policies of any review platform you use with Tradeloper:
- Google: Ask all customers equally. No incentives. No gating. Violation can result in your Google Business Profile being suspended and all reviews deleted.
- Facebook: Recommendations must be genuine. Ask all customers equally.
- Yelp: Do not use Tradeloper to solicit Yelp reviews. Yelp prohibits this entirely.
5. AI-Generated Content
- Do not publish AI-generated social posts that are false, misleading, or defamatory.
- Review all AI-generated content before publishing. You are responsible for what you post.
- Do not use AI posts to make claims about competitors that are false or unverifiable.
6. Enforcement
If we become aware of a violation of this policy, we may:
- Issue a warning and require you to correct the issue
- Suspend your account temporarily
- Terminate your account permanently without refund
- Report illegal activity to relevant authorities if required by law
